COMMISSIONED ARTWORK

Process & Approval
‍

1. All commissioned artwork (murals, fine art, tattoos) begins with a consultation and requires a signed agreement.
2. Projects proceed based on approved concepts. Substantial changes requested after concept approval may incur additional fees.
3. Final artwork may vary slightly from approved concepts due to the artistic process, medium requirements, or site conditions.

Deposits & Payment
‍

1. A non-refundable deposit (30-50% depending on project scope) is required to secure your booking and begin work.
2. Remaining balance is due upon completion unless otherwise specified in your contract.
3. For large projects, a payment schedule may be established in your contract.

Cancellation Policy
‍

1. Client cancellations after work has begun forfeit the deposit.
2. Cancellations within 48 hours of scheduled tattoo appointments forfeit the deposit.
3. For mural or large-scale projects, cancellation fees will be outlined in your contract.
   ‍

Intellectual Property
‍

1. Ache Hernandez retains the copyright to all artwork created, including the right to use images of completed work for portfolio, promotional, and exhibition purposes.
2. Clients receive a license to display and enjoy the artwork but may not reproduce it commercially without written permission.
3. Custom designs created but not executed remain the intellectual property of Ache Hernandez and may not be used by other artists.

PERFORMANCE SERVICES

1. Performance bookings require a signed contract and deposit.
2. Cancellation fees apply as specified in individual performance contracts.
3. Recordings of performances may be used for portfolio purposes unless otherwise specified in writing.

1. Content on this website is for informational purposes only.
2. All images and content are copyright protected and may not be used without permission.
3. We are not responsible for the content of external websites linked from our site.

LIMITATION OF LIABILITY
‍

1. While we strive for excellence in all services, we cannot guarantee specific emotional reactions or business outcomes from artwork.
2. For tattoos, aftercare instructions must be followed precisely; failure to do so may affect the final outcome and void any touch-up guarantees.
3. We are not liable for any business disruption during mural installation beyond what is outlined in your contract.

GOVERNING LAW

These Terms & Conditions are governed by and construed in accordance with Canadian law. Any disputes shall be subject to the exclusive jurisdiction of the Canadian courts.

CHANGES TO TERMS
‍

We reserve the right to modify these terms at any time. Changes will be posted on this website. Your continued use of our services following any changes constitutes acceptance of those changes.
